SHOP & WORKSHOP TERMS AND CONDITIONS (General Terms & Conditions)

The following terms and conditions shall apply to all dealings between Into the Future cc trading as ITFuture Computer Solutions (iTFuture), its members and staff and its customers:

Quotations:

• Unless otherwise specified all quotations are valid for two (2) days, from date of quotation. All prices include VAT at current rates (unless otherwise noted)

All quotations for new equipment are subject to change without notice due to the Exchange rate, supplier availability etc

• A deposit will be required on acceptance of all quotations, unless financing of equipment is approved. Full payment on order may be requested on occasion

• A signed quotation by the customer implies acceptance of such, and the customer will become liable for all equipment purchased on the customer’s behalf. A handling fee of 20% will be levied on accepted quotes cancelled before delivery of equipment

• Delivery & acceptance of goods against an unsigned or verbal acceptance of a quote will be as if the quote was signed and the customer accepts responsibility of the amount due

• All cheques to be made out to ITFuture or Into the Future cc. We reserve the right not to accept cheques as payment. Please see our Invoice for our banking details for direct deposits

New Equipment:

• Unless in stock, and subject to supplier availability, all new equipment will be delivered within 48 to 72 hours

• All built systems (Built system – Case with PSU, motherboard, CPU, RAM, any other plug-in cards and drives supplied at time of build, and Screen (excl Keyboard, Mouse, Speakers)) and other components sold have a one-year supplier “carry-in” warranty … regardless of manufacturer warranty, and starting from the date of customer invoice. If different to one year this will be stated on the customers invoice. Where a manufacturer warranty exceeds one year, iTFuture will endevour to assist the customer to have the part swopped out or repaired, courier and other costs will be for the customer’s account. Warranty includes parts and first hour labour, ie warranty includes loading operating system, device drivers and machine necessary software; Warranty excludes loading and/or restoring extra programs, backed up data, etc since original purchase. This is a “Carry-In” Warranty , and call-out fees will be calculated as per normal rates, if so requested. Warranty will be voided if transfer of ownership of equipment occurs

• New upgrades to existing systems carry a one-year supplier “carry-in” warranty, on new parts supplied

• ALL original disks and packaging/boxes to be kept by customer. Warranty may become void without same

• A fee for setup and installation on site will be payable. This fee can be found on our Rates and Charges pricelist or on request

• All supplied complete new systems come with free three month telephonic support, calculated from date of invoice

• Proof of Purchase must accompany any Warranty claim. Please note that our suppliers will not honour any Warranty without correct paperwork and matching serial numbers. Use of generic inks will void any Printer Warranty

Upgrades/Repairs to Existing Equipment

• Unless expressly arranged, any equipment replaced, either as a repair or an upgrade becomes the property of ITFuture

Secondhand Equipment:

• Second-hand equipment is tested by ITFuture, and is supplied with a one-month warranty, unless otherwise stated

Software:

• Unless a disk is physically faulty, NO software is returnable once the packaging has been opened. It is the cusomer’s responsibility to ensure that the software will work on their system before purchase

Support/Maintenance:

• All work is done at the customer’s own risk, and ITFuture, or their members or staff are not responsible for any loss of data or theft out of vehicles or shop, although all possible care will be taken to ensure that there is no loss. This includes damage or loss to/of property, be it fixed or immovable. We will not be responsible for any claim arising due to loss of business/income, implied or otherwise, or any other loss. All data is backed up before work commences, however, iTFuture will not be responsible for any data loss.  iTFuture cannot be resposibile for any equipment failure whilst in iTFuture’s care

• Equipment handed into the shop for repairs, servicing etc and not collected within three months will be sold to defray costs

Programming:

• Any programs written for a customer, are for the customer’s sole use only, and may not without the express written permission of the author, be copied (except for back-up purposes), or be used on more than one PC without the express written permission of the author

ITFuture is not responsible for any damage or loss of income that the program may inadvertently cause in the usage of same

Payments:

• All payments are due on presentation of invoice (C.O.D.), less any deposits paid, unless otherwise arranged or noted on quotation/ invoice

• All cheques to be made out to ITFuture or Into the Future cc. Please see our Invoice for our banking details for direct deposits

• All payments are to be presented to iTFuture free of charge, even if original payment is lost in any form by any bank or banking clearing bureau

• Interest, where allowed by law, will be charged on overdue accounts

Credit Terms:

• We are not a Credit Provider – Any leeway for payment given against our invoice, should not be construed that we have granted any credit terms. This leeway, if given, is only for your convenience to allow you to do direct deposits from your place of business/home

• By accepting our goods, on promise of payment, you, the client, acknowledge that you have the funds to pay for the goods received

General:

• All goods remain the property of ITFuture until paid for in full

• Where a warranty is invoked, ITFuture reserves the right to repair, or have repaired, the faulty equipment. When a decision is made to replace the faulty part, the part may be replaced with a different model of comparable or better quality and specifications. The warranty continues with elapsed time on any replacement, as if the part was not replaced

• Risk of equipment passes to the customer on delivery, and the customer will be responsible for any insurance required

ITFuture can supply systems without an operating system, but this will be noted on the invoice, and ITFuture will not be responsible for any “pirated” software installed on systems supplied by ITFuture . ITFuture does not condone nor does it practice “software piracy”. We do support Freeware and Shareware; however, it is up to the client to comply with any licensing conditions and to ensure any licensing is correctly supplied, safely stored, and to ensure that your software is legal

• We will not copy, use or pass-on any client software, data or personal information (except for backup purposes, which will be deleted on a regular basis); unless instructed to do so by that client, or by government legislation

All sales are final, and no credit or refunds will be given for goods correctly supplied

Errors and Omissions Excepted.

The following applies to all account/outstanding customers:

• The debtor chooses his domicilium citandi et executandi for all purposes of this agreement including the giving of any notice and/or service of any process at the following address:

• The debtor herewith agrees to pay interest at the rate of 2% above current prime lending rate on all amounts outstanding in terms of this agreement, to be calculated on the outstanding and reducing balance as from time to time

• In the event of ITFuture instituting action against the Purchaser in terms of this agreement, the purchaser shall be liable to payITFuture or their attorneys/collection agent on demand all tracing fees, legal costs on an attorney and client scale and collection commission. iTFuture also reserves the right to recover any goods not paid for. In any event these goods will be sold to defray costs. The Purchaser will then still be liable for any differences & costs due

• The purchaser consents to the jurisdiction of the Knysna Magistrate’s Court should ITFuture proceed against the purchaser in terms of this agreement
